Terms of sale



In providing our catalogs, Bertoia Auctions has endeavored to accurately describe all items being sold, but all property herein offered for sale is strictly "as is" and it is the bidder's responsibility to determine the exact condition of each item. No statement in this catalog, bill of sale or invoice shall be deemed to be a warranty, representation, or assumption of liability with respect to age, condition, size, quality, variety, importance, provenance, or historical relevance of any of these items. Any such statements are strictly matters of opinion. Questions pertaining to the sale must be addressed BEFORE the Wednesday of the actual sale. Emails or inquiries received after this date may not be answered.
The Auctioneer will be the final judge as to which bidder is the highest bidder. In the event of any dispute in this matter, the auctioneer shall at his discretion decide to reopen the bidding or not.
Bertoia Auctions reserves to right to close internet bidding on any item if a catalog error is discovered prior to the sale. In the event of an absentee bid, Bertoia personnel will attempt to contact and inform the bidder well in advance, however, in the event the bidder cannot be contacted,the absentee bid will not be executed, and Bertoia Auctions is not held responsible to reopen the bidding on any lot therein.
Although every accommodation is made to ensure the presence of a bid, in the unlikely event of human or technical error, Bertoia Auctions cannot be held responsible for missed bids.
Title to all merchandise shall pass to the highest bidder at the fall of the Auctioneer's "hammer". The purchaser shall assume full risk and responsibility of the lot purchased once title has passed.
Bertoia Auctions is not responsible for any typographical errors or omissions in this catalog or in the subsequent price key. Photographs in the catalog are of the actual objects being sold, but exact condition of the objects offered takes precedence on the day of sale.
All accounts are to be settled by the end of the sale unless other arrangements have been made beforehand.
All sales are final.
In bidding on any lot offered herein the bidder indicates acceptance of these Terms of Sale.
PAYMENT TERMS
Payment MUST be made within 30 days of auction date. Payments exceeding the thirty day period will be subject to an additional $25.00 fee, and a reoccuring interest charge of 1.5%.

Payment may be made by cash (in house) or personal check if credit has been established with Bertoia Auctions, or a letter of bank certification from your local bank. We reserve the right to hold all merchandise paid for by check until such check has cleared the bank.
EBAY BUYERS: Ebay does not readily provide Bertoia Auctions with the personal or payment information that you have already provided to them. To expedite the payment process, if you are a successful bidder, please email your name, UPS shipping address, phone number, winning lot numbers, and method of payment to toys@bertoiaauctions.com so that we may process your invoice. Please allow, at minimum, seven days for the billing process to occur.
PAYMENT METHODS
Payment may be made by cash (in house), personal check, money order, bank wire transfer, VISA or MasterCard , Bidpay , or PayPal . If paying with a credit card, a signed credit card authorization form will be required at time of payment. The credit card authorization form is available to download on our website. Please fill out the form and fax it to our main office at (856)692-8697.
Paypal payments are accepted. Please make payments to toys@bertoiaauctions.com . Due to new security updates regarding transference of funds, all money orders must be made payable to Jeanne Bertoia.
SHIPPING
Bertoia Auctions will pack, ship and insure any items purchased. There is a minimum $15.00 shipping and handling charge, however shipments may exceed this charge. Insurance charge is .50 per $100.00. UPS is the standard mode of shipping. A pick-up fee of $15.00 will be added for Priority Mail. For larger items, we can refer you to a delivery service. Please allow at least 7-10 business days from the receipt of payment for shipping.
International Shipping : All items will be shipped via U.S. Postal Service Global Express or Federal Express. Our policy is to provide accurate information on all customs documentation and all purchases will be noted as merchandise . For larger purchases, Bertoia Auctions can refer you to a delivery service.
SALES TAX
N.J. residents shall be required to pay New Jersey Sales Tax (7%) (3.5% ath the gallery) unless exemption is allowed under the laws regulating such tax. Out of state buyers are not required to pay sales tax.
BIDDING OPTIONS
ABSENTEE BIDDING: As a service to our customers who cannot attend the sale via the internet or in person, Bertoia Auctions will execute absentee bids through our auction house if so authorized by mail or fax . All lots purchased for absentee bidders will be done so at the lowest possible price regardless of the amount of the order bid. We cannot execute "buy" bids. In the event of tie bids between online bidders, absentee bidders, and those present at the auction, preference will be given to the attending bidder. In the event of tie bids between online bidders and absentee bidders, preference will be given to the absentee bid submitted directly to Bertoia Auctions.
A 20% deposit will be required with all absentee bids. In the event items purchased by absentee bid are not full paid for within 15 days, the 20% deposit will be forfeited and the item will be resold.
TELEPHONE BIDDING: As an added courtesy to our absentee bidders, Bertoia Auctions will have telephone lines available for absentee bidders who would like to participate by phone during the auction.
To qualify for a phone line, the same procedure for absentee bids must be followed (see above). The absentee bid form must be completed and mailed or faxed with the lot #(s), title(s), maximum bid ordered and a request for "PHONE".
If the item has reached more than your bid order, you may at that time continue the bidding by phone. If it sells for less than your bid price, then like all absentee bids, it is yours for the hammer price regardless of the amount of your bid.
In the event of more than (10) requests for a phone line on a particular lot, preference will be given to the (10) highest bidders.
Bertoia Auctions cannot guarantee that all phone requests will be honored. Due to heavy demand at certain segments of the auction, it may be impossible to have a line available. Although Bertoia Auctions will try to accommodate each and every request, we cannot assume responsibilities for any missed calls due to human or technical error. In the event of a missed call, the written absentee bid will still be executed. Request for phone lines must be received no later than 5pm, the Wednesday before the actual sale.
INTERNET BIDDING : Internet bidding for Bertoia Auction sales is available through www.EbayLiveAuctions.com as hosted by www.LiveAuctioneers.com and our online catalog is posted several months prior to each auction on both sites.

You will be asked to verify your information. PLEASE MAKE SURE YOUR CONTACT INFORMATION IS CORRECT AND UP-TO-DATE.
Once you have signed up, you are taken to the main page and may view the lots of the catalog at will. You will be sent an automatic reminder email closer to the sale date prompting you with further instructions.

**ATTENTION NEW BIDDERS**
If you do not have a credit card or bank account on file with EbayLiveAuctions.com, you will not be automatically approved. If you do not wish to provide this information via Ebay, you may supply a letter of reference from your bank or several from auction houses where you have a bidding history. If you do not have access to this information, please call our office and we will gladly assist you further in securing your bids. Bertoia Auctions welcomes absentee bids and phone bidding as alternate forms of bidding. BUYERS PREMIUM
A 17% buyer's premium will be added to all successful bids and payable as part of the total purchase price. or if paid by check, money order, or cash (in house), a discounted 15% buyer's premium will apply.
INTERNET BIDDERS: An 22% buyer's premium will be added to all successful online bids and payable as part of the total purchase price regardless of payment method.
